Driver stopped with 3.78 per mille in Mainleus – strange excuses!

In Mainleus, in the Kulmbach district, officials recently stopped a 32-year-old driver whose driving style was anything but safe. He had to undergo an alcohol test, the result of which the police described as “rarely high” and “not everyday” – a total of 3.78 per mille was measured. This car journey ended abruptly for the driver, who said he was dependent on strong medication. The police confiscated his driver's license on site and took him to the hospital for a blood sample. Criminal proceedings for drunk driving are now the result of his risky behavior, which not only endangered his life, but also that of other road users, as the Frankenpost reported.

What are the legal consequences of such violations? In Germany there are strict blood alcohol limits that clearly define potential crimes and administrative offenses. The following applies to drivers: Up to 0.3 per mille one speaks of a relative inability to drive, from 0.5 per mille it gets really expensive. The first offense results in a fine of 500 euros, two points in Flensburg and a one-month driving ban. Things get really serious when the limit exceeds 1.1 per mille: driving is considered a criminal offense and the penalties can be significant. ADAC provides clear regulations for this.

The alcohol limits at a glance

  • 0,0 Promille: Absolutes Alkoholverbot für Fahranfänger und unter 21-Jährige.
  • 0,3 Promille: Beginn der relativen Fahruntüchtigkeit.
  • 0,5 – 1,09 Promille: Ordnungswidrigkeit – 500 Euro Bußgeld, 2 Punkte, 1 Monat Fahrverbot.
  • Ab 1,1 Promille: Absolute Fahruntüchtigkeit – strafbar.
  • Ab 1,6 Promille: MPU (medizinisch-psychologische Untersuchung) zwingend erforderlich.

But these are not the only possible consequences. In the case of alcohol-related accidents, motor vehicle liability insurance can cover the damage, but has the right to claim back up to 5,000 euros. In addition, the penalties for repeat offenders or serious accidents can even lead to prison sentences. The Rechtecheck also provides interesting information that every driver should know.

Alcohol violations in traffic are therefore not a trivial offense. Ultimately, the safety situation on the roads must be guaranteed at all times. Good advice to everyone: It's better to stay away from the wheel when alcohol is involved. If you want to be on the safe side, avoid drinking and driving and use alternative transport options.
